These Terms of Service ("Terms") govern your use of transformwithtoska.com and all services offered by Transform with Toska, operated by Toska Rose trading as Transform with Toska, a VAT-registered business based in the United Kingdom ("we", "us", "our"). By purchasing a product or service, joining the Many Butterflies community, or using our website, you agree to these Terms. Please read them carefully.
These Terms are governed by the laws of England and Wales.
3.1 Workshops and Programmes
When you purchase a workshop or programme, you are purchasing access to a specific scheduled event or course. Prices are shown on the relevant product page. All prices are in GBP or USD as displayed. UK customers will be charged applicable VAT.
3.2 Community Membership
Many Butterflies is a monthly subscription. Your membership begins on the date of your first payment and renews monthly until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.
3.3 Payment
Payments are processed by Stripe (card) or GoCardless (direct debit). By completing a purchase you authorise us to charge the stated amount. For subscriptions, you authorise recurring charges until you cancel.
4.1 Workshops and Programmes
If you cancel at least 7 days before a scheduled workshop, you are entitled to a full refund. Cancellations within 7 days of the event are not eligible for a refund, but you will retain lifetime access to the replay where one is provided. If we cancel or significantly reschedule an event, you will receive a full refund.
4.2 Community Membership
You may cancel your Many Butterflies membership at any time. We do not offer pro-rata refunds for unused portions of a monthly billing period. On cancellation you retain access until the end of the period you have paid for.
4.3 Statutory Rights
Nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Contracts Regulations 2013.
Where we state that a workshop or session includes replay access, we will make a recording available within 5 business days of the live session. We aim to maintain replay access indefinitely but reserve the right to remove recordings with reasonable notice.

All content on our website, in our programmes, workshops, and community — including written content, recordings, frameworks, and methodology — is owned by Transform with Toska and protected by copyright. You may not reproduce, distribute, or use our content for commercial purposes without our written permission.

To the fullest extent permitted by law, our services are provided "as is" and "as available" without any warranty, express or implied. We expressly exclude all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that: (a) our services will be uninterrupted, error-free, or free from viruses or other harmful components; (b) any results obtained from use of our services will be accurate or reliable; (c) any defects in the services will be corrected. You assume full responsibility for your use of our services and any results thereof. Nothing in this clause affects any rights you may have as a consumer under UK law that cannot be excluded or limited.
To the fullest extent permitted by law, Transform with Toska is not liable for any indirect, consequential, incidental, special, or punitive loss or damage arising from your use of our services, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, whether based in contract, tort, negligence, or otherwise, even if we have been advised of the possibility of such loss.
Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be limited or excluded by law.
You agree to indemnify, defend, and hold harmless Transform with Toska, Toska Rose, and any employees, contractors, agents, or representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
Neither party shall be liable for any failure or delay in performance caused by circumstances beyond that party's reasonable control, including acts of God, natural disasters, pandemic, war, government action, power or internet outages, strikes, or failures of third-party services (including Zoom, Telegram, Stripe, or GoCardless).
If a force majeure event prevents us from delivering a workshop or live session for which you have paid, we will offer a rescheduled date or a full refund at your election.
We may update these Terms from time to time. Material changes will be notified by email with reasonable notice. Continued use of our services after the effective date of any change constitutes acceptance of the updated Terms. We reserve the right to change, suspend, or discontinue any service with reasonable notice; where a paid service is discontinued, we will issue a full refund for unused portions.
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be limited to the minimum extent necessary so that the remaining provisions continue in full force and effect.
These Terms, together with our Privacy Policy and AI and Data Statement, constitute the entire agreement between you and Transform with Toska with respect to your use of our services and supersede all prior agreements, representations, and understandings.
No failure or delay by us in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right. A waiver of any breach of these Terms shall not be construed as a waiver of any subsequent breach.
